(a) Intermediary Technology Provider: QSKIP operates strictly as an intermediary technology platform enabling Users to discover independent Partner Outlets and place advance orders for food and beverage items for self-collection at designated pickup locations.

(b) No Food Preparation or Delivery: QSKIP does not own, operate, manage, control, prepare, manufacture, package, store, sell, or deliver any food or beverage products listed on the Platform. All food items are prepared, handled, and supplied exclusively by independent third-party Partner Outlets.

(c) Direct Transaction with Merchant: Any purchase made through the Platform constitutes a direct bilateral commercial contract between the User and the respective Partner Outlet. The Partner Outlet is solely responsible for food safety, preparation, hygiene, ingredients, allergen warnings, portion sizes, packaging, pricing, and compliance with all applicable licensing requirements, including the Food Safety and Standards Act, 2006 (FSSAI).

(d) Accuracy of Listings: Menu descriptions, item availability, ingredients, images, and pricing are supplied directly by the respective Partner Outlets. While QSKIP takes reasonable precautions during merchant onboarding, QSKIP does not independently verify such information and disclaims any liability for inaccuracies or omissions.

(e) Campus and Institutional Outlets: Users ordering from canteens, cafeterias, or food stalls inside universities, corporate facilities, or closed institutions (“Campus Outlets”) acknowledge that access to specific menus or facilities may be restricted based on their institutional membership, physical location, or campus verification.

(f) Order Tracking Estimates: Real-time status indicators (such as “Order Placed”, “Preparing”, and “Ready for Pickup”) represent automated estimations based on Merchant updates. Fulfillment schedules may fluctuate due to kitchen rush, item availability, or counter queues, and QSKIP bears no liability for variations between estimated and actual pickup readiness.

6. Terms of Service with respect to Buyers

By placing an Order through the Platform, the Buyer acknowledges and agrees that:

  • Each Order represents a binding electronic contract to purchase food items from the designated Partner Outlet;
  • Once an Order is confirmed by the Partner Outlet, it cannot be modified or cancelled except as expressly permitted under the Refund Policy;
  • The Buyer must collect the Order from the designated Pickup Location within the pickup window communicated on the Platform;
  • Repeated failure to collect prepared Orders, unauthorized chargebacks, or abusive behavior toward outlet staff may result in immediate suspension or termination of access; and
  • The Platform is designed solely for personal end-consumption. Orders placed for commercial resale, catering arbitrage, or redistribution are strictly prohibited.

7. Order Placement, Collection & Fulfillment

(a) Prepaid Collection Model: All Orders placed via QSKIP are prepaid through integrated digital payment gateways and are prepared for in-person pickup at the Merchant’s designated collection counter. QSKIP does not provide home delivery services.

(b) Perishable Food Notice: Prepared food and beverages are highly perishable. If the Buyer fails to collect the prepared Order within a reasonable time (or before the Partner Outlet’s operational closing time):

  • The Partner Outlet may mark the Order as fulfilled and dispose of the items for health, safety, and hygiene compliance;
  • The Buyer shall have no entitlement to a refund, replacement, or compensation on account of non-collection; and
  • Neither QSKIP nor the Partner Outlet shall bear liability for temperature changes, condensation, loss of crispness, or spoilage resulting from delayed collection.

(c) Deemed Fulfillment: An Order shall be deemed legally fulfilled once the Partner Outlet has prepared the items and made them available for collection at the Pickup Location as indicated on the Platform.

8. Pricing and Payments

(a) Merchant Pricing: Item prices displayed on the Platform are established by the respective Partner Outlets. Users acknowledge that prices on the Platform may differ from offline dine-in or takeaway counter prices due to platform listings, packaging costs, or promotional arrangements.

(b) Additional Transparent Charges: In addition to food item prices, Orders may include transparently disclosed charges such as platform service fees, convenience fees, packaging charges, or applicable taxes. All applicable fees are itemized in the checkout summary prior to payment completion.

(c) Taxes: Prices are inclusive of applicable Goods and Services Tax (GST) and statutory levies unless expressly broken down at checkout.

(d) Payment Processing: Payments are processed through RBI-authorized third-party payment aggregator gateways (such as UPI, debit/credit cards, net banking, and authorized digital wallets). QSKIP acts solely as a limited collection facilitator on behalf of the Partner Outlet.

9. Cancellation and Refunds

Order cancellations and refunds are governed strictly by the QSKIP Cancellation and Refund Policy, which is incorporated into these Terms by reference.

Once an Order is accepted and preparation has commenced at the Partner Outlet, the Order cannot be cancelled by the Buyer. In the event of partner cancellations, stock unavailability, or verified operational failures, refunds will be processed to the original payment method or credited as QSKIP Refund Credits in accordance with the Refund Policy.

10. Dynamic Pricing and Surge Demand

Menu item pricing and service fees may vary periodically based on campus rush hours, operational peak demand, seasonal factors, or merchant promotional campaigns. The price displayed in the checkout order summary at the time of final confirmation constitutes the binding contract price payable for that transaction.

11. Third Party Services

The Platform integrates with independent third-party service providers, including payment gateways, SMS and WhatsApp notification gateways, authentication services, cloud hosting, and analytics infrastructure. These third-party services are governed by their respective terms and privacy notices. QSKIP does not warrant or assume liability for third-party payment failures, bank network timeouts, or external gateway disruptions.

12. Intellectual Property Rights

All Platform IP—including software code, design layouts, graphical assets, branding, logos, database schemas, and algorithms—remains the exclusive property of QSKIP Private Limited or its licensors. Any unauthorized copying, decompilation, scraping, or commercial exploitation constitutes an infringement punishable under applicable civil and criminal statutes.

13. Disclaimer of Warranties

The Platform is provided on an “as is”, “as available”, and “with all faults” basis. To the maximum extent permitted by Applicable Law, QSKIP disclaims all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. QSKIP does not guarantee that menus, preparation alerts, or outlet availability will remain error-free or uninterrupted.

To the fullest extent permitted by law, QSKIP, its directors, officers, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or personal health issues arising from food consumption.

Without limiting the generality of the foregoing, QSKIP bears no liability for food quality, contamination, allergen cross-contact, unhygienic preparation, or packaging errors committed by independent Partner Outlets.

To the maximum extent permitted by law, QSKIP’s aggregate liability arising out of or in connection with any Order shall not exceed the amount actually paid by the User for that specific Order or INR 1,000, whichever is lower.

15. Indemnification

You agree to indemnify, defend, and hold harmless QSKIP Private Limited, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your violation of these Terms or Applicable Law; (b) misuse of the Platform; (c) violation of third-party rights; or (d) disputes between you and any Partner Outlet.

16. Electronic Communications

By registering an Account or placing an Order, you expressly consent to receive electronic communications from QSKIP via SMS, WhatsApp, email, and push notifications for order receipts, counter readiness alerts, operational notices, and security alerts. You may opt out of non-essential promotional messages at any time in your profile settings.

17. QSKIP Credits & Store Balances

QSKIP may issue digital store credits (“QSKIP Credits”) to Users, categorized as either Refund Credits (issued for cancelled orders under the Refund Policy) or Reward Credits (issued for promotional goodwill or marketing campaigns).
